Judge Rebukes Trump-Era Sanctions Against UN Expert, Affirming Free Speech
Francesca Albanese's victory highlights the importance of protecting critical voices on human rights issues, especially regarding the Palestinian territories.

A federal judge has delivered a blow to the legacy of the Trump administration's foreign policy, temporarily blocking sanctions against Francesca Albanese, the UN Special Rapporteur on the Occupied Palestinian Territories. This ruling underscores the importance of protecting free speech, particularly when it challenges powerful interests and advocates for marginalized communities.
The sanctions, imposed by former Secretary of State Marco Rubio in July 2025, effectively barred Albanese from entering the US and utilizing its banking system. These measures were a direct response to Albanese's critical stance on Israel's actions in Gaza and her recommendation that the International Criminal Court (ICC) investigate potential war crimes committed by Israeli and US nationals.
Albanese's role as UN Special Rapporteur is crucial for monitoring and reporting on human rights violations in the occupied Palestinian territories. Her work often involves highlighting the disproportionate impact of Israeli policies on Palestinian civilians and advocating for accountability. The Trump administration's attempt to silence her through sanctions represents a dangerous escalation of efforts to suppress criticism of Israeli policies.
The lawsuit filed by Albanese's husband and daughter, a US citizen, exposed the real-world consequences of these sanctions. The family argued that the measures effectively “debanked” Albanese, making it nearly impossible for her to conduct her daily life and fulfill her duties as UN Special Rapporteur. This case exemplifies how economic sanctions can be weaponized to target individuals and organizations working on human rights issues.
Judge Richard Leon's ruling emphasized that Albanese's residency outside the US did not diminish her First Amendment protections. He recognized that the Trump administration's actions were aimed at suppressing Albanese's speech based on the “idea or message expressed.” This ruling affirms the principle that freedom of speech extends to those who criticize US allies and advocate for international accountability.
“Albanese has done nothing more than speak!” Leon wrote in his opinion, highlighting the absurdity of punishing someone for expressing their views. He further noted that Albanese's recommendations to the ICC were non-binding opinions, underscoring the lack of justification for the sanctions.
